Aim to advance legal knowledge by encouraging research and discourse in criminal and constitutional law and other related fields. We welcome interdisciplinary perspectives and contributions from disciplines like humanities and international relations. Besides, we enrich the understanding of legal issues, especially in the context of Islamic law and its intersection with modern legal systems. We also support legal education and professional development by publishing accessible, high-quality research and analyses for legal academics, students, and professionals. Scope; 1. Islamic Law; 2. Islamic Criminal Law; 3. Islamic Constitutional Law; 4. Criminal and Custom Law; 5. Constitutional and Administrative law; 6. Humaniter's Law and International Law. The articles published in the journal have been reviewed by either Bestari Partners or peer reviewers. The decision to accept or reject a scientific article rests with the Editorial Board, based on the recommendations of Bestari Partners. Al-Daulah: Jurnal Hukum Pidana dan Ketatanegaraan is published twice a year, in June and December. To submit an article, writers must follow the Guidelines for Writing Guidelines.</p> <p>This journal has received accreditation from Akreditasi Jurnal Nasional (ARJUNA) and is officially managed by the Ministry of Research, Technology, and Higher Education of the Republic of Indonesia. <p>This study meticulously examines the historical trajectory of post-classical <em>uṣūl al-fiqh</em> literature, unraveling the enduring legacy of Tāj al-Dīn al-Subkī’s (d. 771/1370) seminal work, <em>Jamʿ al-jawāmiʿ</em>. Authored by the distinguished Shāfiʿī jurist and historian in the 8th/14th century, this treatise has transcended temporal boundaries, evolving into a worldwide cornerstone of Islamic legal education. Using Bloom’s Taxonomy, this research analyses <em>Jamʿ al-jawāmiʿ’</em>s role in the <em>uṣūl al-fiqh </em>tradition. It illustrates how the work quickly gained recognition as a foundational textbook through its conciseness and comprehensiveness, sparking a surge of commentaries from scholars across multiple juristic schools. This investigation explores the key factors that contributed to its initial reception, establishment as a core textbook, and profound impact on subsequent <em>uṣūl al-fiqh </em>scholarship. Drawing on bio-bibliographical sources, the study illuminates the enduring influence of <em>Jamʿ al-jawāmiʿ </em>in shaping the discipline, emphasizing the interplay between base texts (<em>matn</em>) and their commentaries in evolving <em>uṣūl al-fiqh</em> scholarship. The findings challenge assumptions about the originality of commentary literature, encouraging further research into the intricate developments of this intellectual tradition and reinvigorating interest in its interpretive legacies<em>.</em></p>Mohamed Jabir Ali al-Hudawi

<p>This article discusses the urgency of the presidential institution in Indonesia, with a focus on strengthening presidentialism and improving the constitutional system. The article explores the historical context of presidential power and its evolution in responding to political dynamics in the country. Using a qualitative approach, this study analyzes existing literature, legal frameworks, and political practices to evaluate the current state of presidentialism. Key findings suggest that strengthening the presidential institution is crucial for effective governance, especially in improving decision-making processes and ensuring political stability. Furthermore, this article argues that improving the constitutional framework is necessary to balance power dynamics among state institutions. By addressing these crucial areas, this study contributes to a deeper understanding of the role of the presidential institution in promoting democratic governance and enhancing national resilience. Insights gained from this study highlight the importance of a strong presidential system in addressing contemporary challenges faced by Indonesia, and ultimately advocating for reforms that are in line with democratic principles and the aspirations of the Indonesian people.</p>Muhammad Mutawalli, Georges Olemanu Lohalo, Mirela Imširović
