PERLINDUNGAN HUKUM BAGI PENCIPTA LAGU ATAS PELANGGARAN HAK CIPTA LAGU DITINJAU DARI UU NO. 28/2014 TENTANG HAK CIPTA
Abstract
Lagu sebagai salah satu objek yang dilindungi oleh UU No. 28/2014 tentang Hak Cipta, memiliki kompleksitas perlindungan hukum yang signifikan. Meskipun sudah didukung oleh landasan hukum yang kokoh, karya musik tetap rentan terhadap berbagai bentuk pelanggaran hak cipta, terutama karena nilai ekonomi yang melekat padanya. Keuntungan finansial dan peningkatan popularitas yang dapat diperoleh dari sebuah lagu sebanding dengan risiko penyalahgunaan, seperti penggandaan, perubahan lirik, pembawaan, atau publikasi tanpa izin dari pencipta. Penelitian ini bertujuan untuk menganalisis perlindungan hukum bagi pencipta lagu menggunakan metode kualitatif dengan pendekatan yuridis normatif. Fokus penelitian meliputi dua strategi perlindungan: preventif dan represif. Perlindungan preventif bertujuan mencegah pelanggaran melalui ketentuan dalam undang-undang, sedangkan perlindungan represif dilakukan melalui mekanisme hukum setelah pelanggaran terjadi, dengan tujuan memberikan perlindungan yang menyeluruh terhadap hak-hak pencipta lagu.

Abstract
Songs are one of the objects protected by Law no. 28/2014 concerning Copyright, has significant legal protection complexity. Even though it is supported by a solid legal foundation, musical works remain vulnerable to various forms of copyright infringement, especially because of the economic value attached to them. The financial gain and increase in popularity that can be gained from a song is outweighed by the risks of covers, such as duplication, changes to lyrics, renditions, or publication without permission from the composer. This research aims to analyze legal protection for songwriters using qualitative methods with a normative juridical approach. The research focus includes two protection strategies: preventive and repressive. Preventive protection aims to prevent violations through provisions in law, while repressive protection is carried out through legal mechanisms for violations that occur, with the aim of providing comprehensive protection for the rights of songwriters.
