DINAMIKA POLITIK HUKUM DALAM PENGESAHAN UNDANG-UNDANG CIPTA KERJA DI INDONESIA: ANTARA EFISIENSI EKONOMI DAN RESISTENSI SOSIAL

Undang-Undang Cipta Kerja (UUCK) merupakan salah satu produk hukum yang mencerminkan dinamika politik hukum di Indonesia. Dengan pendekatan omnibus law, UUCK bertujuan untuk meningkatkan investasi dan efisiensi regulasi. Namun, pengesahannya memunculkan pro dan kontra di masyarakat. Penelitian ini menganalisis politik hukum di balik pengesahan UUCK, mengkaji faktor-faktor yang memengaruhi pembentukannya, serta dampaknya terhadap prinsip negara hukum dan demokrasi. Penelitian ini menggunakan metode yuridis-sosiologis dengan pendekatan analisis dokumen dan wawancara mendalam. Hasil penelitian menunjukkan bahwa UUCK mencerminkan dominasi kepentingan ekonomi dalam politik hukum, tetapi mengabaikan partisipasi publik yang memadai, sehingga memicu resistensi sosial.

Abstract
The Job Creation Law (UUCK) is one of the legal products that reflects the dynamics of legal politics in Indonesia. With an omnibus law approach, UUCK aims to increase investment and regulatory efficiency. However, its ratification has raised pros and cons in society. This article analyzes the legal politics behind the ratification of UUCK, examines the factors that influenced its formation, and its impact on the principles of the rule of law and democracy. This study uses a juridical-sociological method with a document analysis approach and in-depth interviews. The results of the study show that UUCK reflects the dominance of economic interests in legal politics, but ignores adequate public participation, thus triggering social resistance.
