PERLINDUNGAN HUKUM TERHADAP PASIEN DALAM KONTRAK TERAPEUTIK
Abstract
Hubungan dokter dengan pasien dalam pelayanan kesehatan lahir karena adanya kesepakatan antara dua pihak yang didasarkan perjanjian. Perjanjian tersebut merupakan kontrak terapeutik yang semula bersifat paternalistic aktif-pasif. Namun, pada perkembangan selanjutnya terjadi pergeseran paradigma mengarah pada hubungan yang egalitarian yaitu bersifat horizontal kontraktual. Tujuannya menyembuhkan dan mencegah penyakit, meringankan penderitaan pasien, mendampingi pasien. Apabila dokter melalaikan tanggung jawabnya, maka pasien dapat menggugat dokter melakukan wanprestasi.
Doctor-patient relationship in health care was born due to an agreement between the two parties based on agreement. The agreement is a contract which was originally to be paternalistic therapeutic active-passive. But, on further developments paradigm shift leads to a relationship that is egalitarian horizontal contractual nature. The goal is to cure and prevent disease, alleviate the suffering of the patient, with the patient. When doctors neglect onus, then the total patients sue doctors are in default.
