ASAS IKTIKAD BAIK DALAM PERJANJIAN KREDIT PEMILIKAN RUMAH
Abstract
The house is a basic need that has a role in the forming the character and personality of the nation. In order to accommodate the needs of people to own a home, then the banks offering credit facilities (KPR). However, in practice, some clauses does not yet reflect the good faith principle that should be applied in an agreement. Therefore, the agreement made by the banks should heed the principle of good faith in every clause of the agreement as well as to adjust to the provisions of Law No. 8 of 1999 on Consumer Protection.

Rumah merupakan kebutuhan dasar yang berperan penting dalam pembentukan watak serta kepribadian bangsa. Dalam rangka mengakomodasi kebutuhan masyarakat untuk memiliki rumah, maka pihak perbankan menawarkan fasilitas Kredit Pemilikan Rumah (KPR). Namun dalam praktiknya, beberapa klausul dalam Perjanjian KPR belum mencerminkan adanya asas iktikad baik yang seharusnya diterapkan dalam suatu perjanjian. Oleh karena itu, Perjanjian KPR yang dibuat oleh pihak perbankan seharusnya mengindahkan asas iktikad baik dalam setiap klausul perjanjiannya serta menyesuaikan dengan ketentuan dalam Undang-undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen.
