CRITICAL STUDY OF CRIMINAL SANCTIONS FOR CHILD NEGLECT BY PARENTS IN INDONESIA
Abstrak
Kasus penelantaran terhadap anak dianggap salah satu indikator minimnya kualitas perlindungan anak di indonesia. Hukum yang diperlukan adalah hukum pidana karena dianggap efektif. Sanksi bagi pelaku tindak pidana penelantaran anak dijelaskan dalam Undang-undang Nomor 35 Tahun 2014 Tentang Perubahan Atas Undang-undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak. Ketentuan Pidana, Pasal 77B “Setiap Orang yang melanggar ketentuan sebagaimana dimaksud dalam Pasal 76B (“Setiap Orang dilarang menempatkan, membiarkan, melibatkan, menyuruh melibatkan Anak dalam situasi perlakuan salah dan penelantaran”), dipidana dengan pidana penjara paling lama 5 (lima) tahun dan/atau denda paling banyak Rp100.000.000,00 (seratus juta rupiah)”, akan tetapi faktanya bahwa sanksi kepada orang tua yang tidak menafkahi anak sebagaimana Putusan pengadilan tentang kewajiban Pembayaran nafkah anak, khusus bagi seorang Ayah, hampir tidak pernah Terlaksana karena payung hukum yang memberikan sanksi kepada ayah yang tidak menafkahi anak belum ada secara spesifik. Oleh karenanya, Dalam rangka meningkatkan efektifitas penyelenggaraan perlindungan anak, maka perlu adanya ketentuan sanksi pidana terhadap penelantaran anak yang dilakukan oleh Orang tua, khusus bagi ayah yang tidak menjalankan kewajibannya, yaitu dengan Melakukan Revisi terhadap Penjelasan Penjelasan Pasal 76 B Undang-Undang Nomor 35 tahun 2014 tentang Perlindungan Anak, yaitu dengan penambahan redaksi penjelesan pasal, “yang dimaksud dengan Penelantaran, diantaranya adalah Pengingkaran Orang Tua (Ayah) terhadap Pembayaran nafkah Anak berdasarkan Putusan pengadilan Agama yang telah berkekuatan Hukum Tetap.
