STATUS HUKUM NASABAH BNI SYARIAH SETELAH MERGER MENJADI BANK SYARIAH INDONESIA

Penelitian ini membahas tentang bagaimana status hukum nasabah BNI Syariah Makassar setelah merger menjadi Bank Syariah Indonesia. Kelahiran Bank Syariah Indonesia, penggabungan tiga Bank Syariah, turut mempergaruhi status nasabah ketiga Bank Syariah tersebut. Masing-masing bank syariah ini dan nasabahnya terikat oleh suatu perjanjian yang melandasi hubungan hukum perdata antara nasabah dan bank tersebut. Dengan merger menjadi Bank Syariah Indonesia, mau tidak mau nasabah harus dipindahkan dari status lamanya. Jenis penelitin yang digunakan dalam penelitian ini adalah Penelitian Lapangan (Field Research), menggunakan metode penelitian wawancara dan kepustakaan sebagai teknik pengumpulan data yang kemudian dianalisis secara kualitatif dan disajikan secara deskriptif. Hasil penelitian tersebut menunjukkan bahwa ketika nasabah BNI Syariah menyetujuai penawaran untuk penggantian buku tabungan dan ATM BNI Syariah ke BSI, maka lahirlah perjanjian baru berdasarkan Pasal 1338 KUHPerdata sepanjang memenuhi syarat Pasal 1320 KUHperdata, maka lahirlah hubungan hukum yang mengikat antara nasabah ex BNI Syariah dengan BSI. Implikasi dari penelitian ini Perlu untuk dilakukan sosialisasi lebih lanjut yang lebih tersrtuktur dan sistematis dalam rangka memberikan edukasi kepada nasabah dari ketiga bank syariah yang merger. Pemahaman nasabah akan Bank Syariah Indonesia, baik dari segi operasiponal dan target bisnis tentunya juga harus diiringi dengan pemahaman nasabah terhadap kesadaran hukumnya, terutama hubungan hukumnya dengan pihak Bank Syariah Indonesia yang berlandaskan hubungan keperdataan.

Abstract
This study discusses how the legal status of BNI Syariah Makassar customers after the merger into Bank Syariah Indonesia. The birth of Bank Syariah Indonesia, the merger of three Islamic banks, also influenced the customer status of the three Islamic banks. Each of these Islamic banks and their customers are bound by an agreement that underlies the civil law relationship between the customer and the bank. With the merger to become Bank Syariah Indonesia, like it or not, customers must be transferred from their former status. The type of research used in this research is Field Research, using interview and library research methods as data collection techniques which are then analyzed qualitatively and presented descriptively. The results of this study indicate that when BNI Syariah customers agree to an offer to replace BNI Syariah savings books and ATMs to BSI, a new agreement is born based on Article 1338 of the Civil Code as long as it meets the requirements of Article 1320 of the Civil Code, then a binding legal relationship is born between ex BNI Syariah customers and BSI. . Implications of this research It is necessary to conduct further socialization that is more structured and systematic in order to provide education to customers of the three merged Islamic banks. The customer's understanding of Bank Syariah Indonesia, both in terms of operational and business targets, of course, must also be accompanied by customer understanding of their legal awareness, especially their legal relationship with Bank Syariah Indonesia which is based on civil relations.
