TINJAUAN HUKUM ISLAM TERHADAP PELAKSANAAN PEMBIAYAAN MUSYARAKAH PADA PT. BANK SYARIAH INDONESIA KANTOR CABANG MAKASSAR VETERAN

Mekanisme pembiayaan musyarakah pada Bank Syariah Indoensia Tbk KC Makassar Veteran yakni menggunakan penggabungan semua modal dari kedua belah pihak antara bank dan juga nasabah untuk dijadikan modal usaha dan dikolola secara bersama-sama, Setiap pemilik modal berhak turut serta dalam menentukan kebijakan dalam melakukan usaha yang akan di jalankannya, dan pelaku usaha yang akan menjalankan usaha agar tercapai tujuan dari kedua belah pihak sebelum terjadi perjanjian antara bank dan juga nasabah, serta akad yang akan di perjanjikan harus di uraikan dalam surat perjanjian. Kedua, Ketentuannya telah sesuai dengan fatwa DSN-MUI No.8 tahun 2000 serta fatwa DSN-MUI No. 73 tahun 2008. Kedua belah pihak harus lebih memahami akad serta agunan yang akan di lakukan dalam menjalankan suatu usaha dengan mempertimbangkan resiko yang akan di terima, serta peningkatan pengawasan dari pihak bank agar resiko bisa lebih rendah.

Abstract
The mechanism for musharaka financing at Bank Syariah Indonesia Tbk KC Makassar Veterans is to use the combination of all capital from both parties between the bank and the customer to be used as business capital and managed together. carried out, and business actors who will run the business in order to achieve the goals of both parties before an agreement occurs between the bank and the customer, as well as the contract to be agreed upon must be described in the agreement letter. Second, the provisions are in accordance with the DSN-MUI fatwa No. 8 of 2000 and the DSN-MUI fatwa No. 73 of 2008. Both parties must better understand the contract and collateral that will be carried out in running a business by considering the risks that will be accepted, as well as increasing supervision from the bank so that the risk can be lower.
