Penyelesaian sengketa tanah warisan melalui jalur non litigasi di Kelurahan Salaka dilakukan di luar Pengadilan dengan menggunakan mediator sebagai pihak penengah yang dipilih berdasarkan kesepakatan para pihak. Dalam hal ini, mediator berusaha membangun komunikasi sehingga dapat mempertemukan keinginan para pihak. Proses penyelesaian sengketa secara litigasi (di pengadilan) yang menganut asas sederhana, cepat, dan biaya ringan pada realitasnya sering mengalami kendala, seperti banyaknya jumlah perkara yang masuk tidak sebanding dengan jumlah tenaga hakim sehingga berdampak pada masyarakat selaku pencari keadilan merasa kesulitan untuk berperkara di pengadilan guna mendapatkan haknya secara cepat. Selain itu, faktor biaya ringan dan waktu yang efisien serta kerahasiaan dari penyelesaian sengketa secara non litigasi (di luar pengadilan) juga menjadi faktor yang membuat masyarakat lebih memilih penyelesaian sengketa di luar pengadilan. Berdasarkan masalah tersebut, maka penulis tertarik untuk meneliti lebih lanjut mengenai penyelesian sengketa tanah warisan melalui jalur non litigasi khususnya di Kelurahan Salaka. Hukum dan keadilan merupakan dua aspek yang tidak dapat dipisahkan. Hal tersebut dikarenakan bahwa tujuan dari hukum semata-mata untuk keadilan sebagaimana menurut Geny dalam bukunya Ahmad Ali. Selanjutnya, hal tersebut dirumuskan menjadi karya ilmiah dengan mengambil judul “Tinjauan Hukum Islam Terhadap Penyelesaian Sengketa Tanah Warisan Melalui Jalur Non Litigasi (Studi Kasus di Kelurahan Salaka, Kecamatan Pattallassang, Kabupaten Takalar).”

Abstract
Settlement of inheritance land disputes through non-litigation channels in Salaka village is carried out outside the court by using a mediator as a mediator who is selected based on the agreement of the parties. In this case, the mediator tries to build communication so that it can bring together the wishes of the parties. The process of litigation dispute resolution (in court) which adheres to the principles of simple, fast dam low cost in reality often experiences problems, such as the large number of cases that are entered not proportional to the number of judges so that it has an impact on the community as justice seekers find it difficult to take cases in court in order to get it right quickly. In addition, the low cost factor and efficient time and confidentiality of non-litigation (outside court) dispute resolution are also factors that make people prefer to settle disputes out of court. Based on these problems, the authors are interested in researching further regarding the settlement of inheritance land disputes through non-litigation channels, especially in the Salaka village. Law and justice are two aspects that cannot be separated. This is because the purpose of the law is solely for justice as according to Geny in Ahmad Ali book’s. furthermore, it was formulated into a scientific paper with the title “Overview Of Islamic Law On The Settlement Of Inheritance Land Disputes Through Non Litigation Channels (Case study in Salaka Vilage, Pattallassang District, Takalar Regency)”.
