TINJAUAN HUKUM ISLAM TERHADAP JUAL BELI LAHAN BUDIDAYA RUMPUT LAUT DI KELURAHAN AKKAJENG KECAMATAN SAJOANGING KABUPATEN WAJO

Jual beli lahan budidaya rumput laut yang terjadi di Kelurahan Akkajeng Kecamatan Sajoanging Kabupaten Wajo yang mana objek yang diperjualbelikan yaitu laut yang merupakan milik negara, dimana pihak penjual menjual laut yang dikatakan miliknya kepada pihak pembeli dengan harga yang cukup tinggi namun keuntungan sangat menjanjikan. Rumusan masalah dalam yaitu : Bagaimana status penguasaaan lahan budidaya rumput laut, Bagaimana pelaksanaan jual beli lahan budidaya rumput laut, dan Bagaimana pandangan hukum Islam terhadap jual beli lahan budidaya rumput laut di Kelurahan Akkajeng Kecamatan Sajoanging Kabupaten Wajo. Penelitian ini bersifat tinjauan lapangan (field research) dan menggunakan metode penelitian kualitatif. Pengumpulan data pada penelitian ini menggunakan metode wawancara, observasi, dan dokumentasi. Jual beli lahan budidaya rumput laut di Kelurahan Akkajeng Kecamatan Sajoanging Kabupaten Wajo bertentangan dengan tujuan dari jual beli dalam fiqh mu’amalah karna warga mengambil kesempatan dari kewenangan yang diberikan atas laut tersebut dan mengambil keuntungan secara pribadi, yang seharusnya adalah laut tidak dapat dimiliki dan hanya bisa dimanfaatkan, maka sudah sepatutnya masyarakat/nelayan pembudidaya rumput laut menetapkan tanda batas pengkaplingan serta mempunyai SIUP sebagai dasar penguasaan dan penggunaan wilayah pantai untuk usaha budidaya rumput laut.

Abstract
The sale and purchase of seaweed cultivation land that occurred in Akkajeng Village, Sajoanging District, Wajo Regency, where the object being traded is the sea which belongs to the state, where the seller sells the sea which is said to be his to the buyer at a fairly high price but very promising profits. The formulation of the internal problem is: What is the status of controlling seaweed cultivation land, How is the implementation of buying and selling seaweed cultivation land, and What is the view of Islamic law on buying and selling seaweed cultivation land in Akkajeng Village, Sajoanging District, Wajo Regency. This research is a field research and uses qualitative research methods. Collecting data in this study using interviews, observation, and documentation. The buying and selling of seaweed cultivation land in Akkajeng Village, Sajoanging Subdistrict, Wajo Regency is contrary to the purpose of buying and selling in fiqh mu'amalah kama. Residents take advantage of the authority given over the sea and take advantage personally, what should be is that the sea cannot be owned and only If it can be utilized, then it is appropriate for seaweed cultivators to determine the fishermen community for seaweed cultivators to set boundaries for plotting and have a SIUP as the basis for the control and use of coastal areas for seaweed cultivation.
