ANALISIS PRAKTIK JUAL BELI ONLINE MELALUI APLIKASI WHATSAPP MENURUT PERSPEKTIF HUKUM ISLAM (STUDI KASUS GRUP WHATSAPP PASAR UMUM GHA, KABUPATEN BEKASI)

Artikel ini mengkaji tentang analisis jual beli online melalui aplikasi WhatsApp Menurut Perspektif Hukum Islam (Studi Kasus Grup WhatsApp Pasar Umum GHA, Kabupaten Bekasi). Pokok masalah yang pertama dari penelitian ini yaitu praktik jual beli online melalui aplikasi WhatsApp sebagai aplikasi media sosial yang memiliki pengguna terbanyak di Indonesia. Pokok masalah yang kedua yaitu perspektif hukum Islam terhadap praktik jual beli online melalui aplikasi WhatsApp. Tujuan dari penelitian ini adalah untuk mengetahui dan memahami praktik jual beli online di Grup WhatsApp Pasar Umum GHA dan perspektif hukum Islam mengenai praktik jual beli online di Grup WhatsApp Pasar Umum GHA. Metode penelitian ini menggunakan pendekatan kualitatif jenis studi kasus atau penelitian lapangan dengan teknik observasi dan wawancara kepada peserta Grup WhatsApp Pasar Umum GHA, Kabupaten Bekasi, yang berjumlah 30 informan. Hasil penelitian menunjukkan bahwa praktik jual beli secara online yang dilakukan oleh peserta Grup WhatsApp Pasar Umum GHA bermula dari penjual yang memasarkan barang dagangan di grup kemudian pembeli yang berniat membeli akan menghubungi penjual melalui pesan pribadi di aplikasi WhatsApp. Pada pesan pribadi tersebut akan terjadi kesepakatan mengenai waktu dan tempat penyerahan barang, serta kesepakatan mengenai metode pembayaran. Adapun praktik tersebut menurut perspektif hukum Islam sudah memenuhi prinsip muamalah, rukun dan syarat jual beli, serta syarat pada jual beli musawamah, salam, dan istishna’ sebagai jenis jual beli yang dilakukan oleh peserta Grup WhatsApp Pasar Umum GHA.

Abstract
The research analyses the practice of online buying and selling through WhatsApp from the Islamic law perspective. This is a case study of the buying and selling activities of the GHA public market WhatsApp group, in Bekasi. The study explains how the researcher focuses on two main research problems. As the most used social media in Indonesia, WhatsApp online buying and selling becomes the main problem of the study followed by the Islamic law views on such practice as the second problem. This case study belongs to qualitative research. The researcher aims to explore in depth the practice of online buying and selling using a variety of data collection procedures, which involves observation and interview of thirty participants of WhatsApp group members of the GHA public market in Bekasi. The study found that the vendors benefit the WhatsApp using the WhatsApp group to market the products in which the potential buyers privately respond and text the vendors using the same application. The buyers and vendors agree on the time and place to exchange the money with the products using a particular accepted payment method. These online buying and selling activities are regarded as legal practice in the perspective of Islamic law. The practices have been meeting the principles of muamalah, the pillars, term and conditions of selling and buying such as musawamah, salam, and istishna’.
