Penelitian ini bertujuan untuk memberikan tinjauan hukum terhadap Putusan Nomor 20/Pdt.G/2020/PTA.JB yang berkaitan dengan perkara perbuatan melawan hukum yang diputuskan oleh Pengadilan Tinggi Agama Jambi. Fokus utama dari penelitian ini adalah menganalisis bagaimana pengadilan dalam perkara tersebut menilai dan menerapkan prinsip hukum mengenai perbuatan melawan hukum dalam konteks hukum perdata, khususnya yang berlaku di lingkungan peradilan agama. Metode yang digunakan adalah pendekatan yuridis normatif dengan menelaah putusan tersebut secara mendalam, serta mengkaji relevansi dan kesesuaian keputusan dengan peraturan perundang-undangan yang berlaku, seperti Kitab Undang-Undang Hukum Perdata (KUHPerdata) dan peraturan terkait hukum agama. Penelitian ini juga mengkaji bagaimana putusan tersebut berhubungan dengan asas keadilan, kepastian hukum, dan perlindungan hak-hak pihak yang bersengketa. Berdasarkan analisis terhadap putusan tersebut, penelitian ini menemukan bahwa meskipun keputusan pengadilan sudah sesuai dengan ketentuan hukum yang berlaku, terdapat beberapa perbedaan interpretasi dalam penerapan pasal-pasal terkait perbuatan melawan hukum. Temuan ini menunjukkan perlunya penguatan pemahaman dan penerapan prinsip keadilan dalam keputusan-keputusan pengadilan di Indonesia, terutama yang melibatkan hukum perdata agama.

Abstract
This study aims to provide a legal review of Decision Number 20/Pdt.G/2020/PTA.JB concerning an unlawful act case adjudicated by the Jambi High Religious Court. The primary focus of this research is to analyze how the court assessed and applied legal principles related to unlawful acts in the context of civil law, particularly within the scope of religious court jurisdiction. The methodology employed is a normative juridical approach, which involves a detailed examination of the decision and an evaluation of its alignment with relevant laws and regulations, such as the Indonesian Civil Code (KUHPerdata) and applicable religious law provisions. This study also examines how the decision relates to the principles of justice, legal certainty, and the protection of the rights of the parties involved in the dispute. Based on the analysis of the ruling, the research finds that while the court's decision adheres to the prevailing legal provisions, there are some differences in the interpretation of the articles related to unlawful acts. These findings suggest the need for a stronger understanding and application of justice principles in court decisions in Indonesia, particularly those involving civil religious law.
