FUNGSI DAN PERAN ADVOKAT SEBAGAI PILAR KEADILAN DAN PERLINDUNGAN HAK DALAM PENEGAKAN HUKUM

Kehadiran advokat sangat penting untuk melindungi hak dan kepentingan klien, terutama karena sebagian besar masyarakat Indonesia memiliki keterbatasan dalam memahami hukum. Pada kenyataannya advokat sebagai penegak hukum dalam membela hak dan memperjuangkan keadilan menghadapi berbagai tantangan dan hambatan yang dapat mempersulit advokat. Penelitian ini menggunakan pendekatan yuridis normatif. Penelitian ini bertujuan untuk menganalisis dan menyoroti pentingnya peran dan fungsi advokat dalam mengawal hak dan keadilan serta tantangan yang dihadapi advokat dalam menjalankan kewajibannya. Peran advokat dalam penegakan hukum tidak hanya berfokus pada memenangkan perkara, tetapi juga pada memperjuangkan kebenaran dan keadilan bagi klien. Hasil penelitian menunjukkan bahwa peran dan fungsi advokat sebagai penegak hukum untuk tercapainya keadilan dan perlindungan hak sangatlah penting bagi masyarakat Indonesia yang memerlukan bantuan hukum. Tantangan dan hambatan yang harus dihadapi advokat ialah seperti ketidaktahuan masyarakat terkait pentingnya pendampingan hukum, penyidik yang menganggap advokat dapat memperumit masalah hukum, adanya praktik makelar kasus. Namun terhadap tantangan tersebut advokat memiliki perlindungan hukum yang dapat membantu advokat bekerja tanpa hambatan seperti hak imunitas advokat yang terdapat dalam Pasal 16 Undang-Undang Nomor 18 Tahun 2003 tentang Advokat, berdasarkan Undang-Undang Nomor 18 Tahun 2003 tentang Advokat, advokat merupakan penegak hukum dengan posisi yang sejajar dengan penegak hukum lainnya dalam usaha menegakkan hukum dan keadilan.

Abstrak
The presence of advocates is crucial in protecting the rights and interests of clients, especially since the majority of Indonesians face limitations in understanding the law. In reality, advocates, as legal enforcers defending rights and advocating for justice, encounter various challenges and obstacles that can complicate their work. This study employs a normative juridical approach. It aims to analyze and highlight the importance of the role and function of advocates in safeguarding rights and justice, as well as the challenges they face in carrying out their obligation. The role of advocates in law enforcement extends beyond winning cases; it also involves fighting for truth and justice for their clients. The findings of this study reveal that the role and function of advocates as legal enforcers are essential for achieving justice and protecting rights, particularly for Indonesians in need of legal assistance. The challenges and obstacles faced by advocates include public ignorance of the importance of legal representation, law enforcement officers perceiving advocates as complicating legal processes, and the presence of case-brokering practices. However, in addressing these challenges, advocates are supported by legal protections that enable them to work without hindrance, such as the immunity rights stipulated in Article 16 of Law No. 18 of 2003 on Advocates. According to this law, advocates are legal enforcers with an equal position to other law enforcement officials in the pursuit of justice and the rule of law.
