SISTEM BAGI HASIL PENGGARAPAN SAWAH (TESENG) MENURUT HUKUM ISLAM

Abstract

The main problem in this research is "The Sharing System for Cultivating Rice Fields (Teseng) according to Islamic Law (Case Study in Sangiasseri Village, South Sinjai District, Sinjai Regency)", with sub-problems namely: How is the profit sharing system for cultivating rice fields (Teseng) in Sangiasseri Village, Sub-district South Sinjai, Sinjai Regency? What is the view of Islamic law on the profit sharing system for cultivating rice fields (teseng)? This study uses a descriptive type in the form of field research (file research) with the research approach used is an empirical approach. The data sources for this research are the farmers who cultivate the rice fields in the Sangiasseri village. Data collection methods used are observation, interviews, and documentation. Data analysis was carried out in three stages, namely data reduction, data presentation, and drawing conclusions. The results of this study indicate that, as has been practiced by the community in Sangiasseri village about sharing the results of cultivating rice fields (teseng) it is permissible by syara' because it is known in Islamic teachings as Muzara'ah and Mukharabah, where Muzara'ah is managing land in for something it produces and the seed comes from the owner of the land. As for Mukhabarah, it is the same as Muzara'ah, only the seeds come from the manager. This cooperation is allowed in Islam because of mutual help between one individual and another. And this profit sharing has been practiced by the Prophet Muhammad, and his companions. The implication in this research is that in a profit-sharing cooperation agreement, an agreement should be made on paper or in writing so that it has legal force, because we do not know that there are people (between the two parties) who break the agreement. It is also recommended to every land owner, especially those whose land is not cultivated (uncultivated land) so that they can give it to others for their productivity use, so that they can support the economy of others and for the land owners themselves.
