MUCIKARI DALAM PROSTITUSI ONLINE PERSPEKTIIF HUKUM PIDANA DAN HUKUM ISLAM

Tulisan ini membahas tentang  status hukum mucikari dalam hukum pidana dan hukum Islam. Tulisan ini menggunakan metode penelitian lapangan (field research), penelitian yang terjun ke lapangan  dengan diperkuat hasil wawancara dan dokumentasi. Hasil  penelitian ini menunjukan bahwa  mucikari terjerat pasal per 296 KUHP dan 506 KUHP dan bisa saja mucikari terkena pasal (1 ayat 1 undang-undang nomor 21 tahun 2007) tentang tindak perdangan manusia serta undang-undang (ITE) jika salah satu unsur dari undang undang tersebut terpenuhi misalnya menampung dalam UU perdangangan manusia dan menyebarkan foto atau video porno PSK dalam UU (ITE).

Abstract

This paper discusses the legal status of pimps in criminal law and Islamic law. The problem is then organized into subproblems or research statements, namely: 1. How is the practice of pimps in online prostitution? 2. What are the legal consequences caused by pimps? 3. What is the legal status of pimps in criminal law and Islamic law ?. This paper uses the field research method, in which the writer directly enters the fielhd by strengthening the results of interviews and documentation. The results of this study indicate that it is clear that pimps are ensnared by article 296 of the Indhonesian Criminal Code and 506 of the Indonesian Criminal Code and that pimps may be affected by article (1 paragraph 1 of law number 21 of 2007) concerning human trafficking and law (ITE) if one element of the law the law was fulfilled for example accommodatin in the human trade law and spreading pornographic pornographic videos or videos in the Act (ITE).
